As per the case of IndraSa, the state's OBC Commission can not add any new caste to the OBC list till the list of the castes has been reviewed, but the state government had notified these 39 castes in 1994 without the review of OBC commissions. At that time, in the year 1953, when the report was given by the Parri ChandLaal Majumdar Commission, the State Government had added these 39 castes to the OBC list in 1994.

In the High Court, the petitioner's lawyer has said that this is a caste that did not accept even before the Bakhshpanch or the Mandal Commission. It has been demanded in the petition that these 39 castes should be removed from the OBC list and recruitment of those recruited in various government departments after considering the list of current OBCs is also canceled. Based on this application, the High Court has issued notice to the Central Ministry of State, Social Justice and Empowerment and the National Commission for Backward Class (NCBC).
